The Federal Communications Commission (FCC) has recently introduced a new set of rules aimed at regulating the use of artificial intelligence in robocalls. The proposal follows the FCC’s previous ban on AI-generated robocalls without the explicit consent of the recipient.

Under the proposed rules, robocallers would be required to disclose their use of artificial intelligence when making phone calls or sending text messages. This disclosure must be made while seeking consent from the recipient for future communications. The FCC believes that such disclosures are necessary due to the elevated risk of fraud and scams associated with AI-generated calls.

The FCC proposes to define an “AI-generated call” as any call that utilizes technology to produce an artificial or prerecorded voice or text using computational technology, machine learning, predictive algorithms, and large language models. This definition is intended to encompass a wide range of AI-based communication methods.

The FCC also plans to create an exception for individuals with speech and hearing disabilities who rely on AI-generated voice software for outbound phone calls. However, this exception comes with conditions – there should be no unsolicited advertisements in such calls, and recipients should not incur any charges for receiving them.

These new rules proposed by the FCC mark a significant step towards regulating the use of artificial intelligence in robocalling. By requiring robocallers to disclose their use of AI and establishing guidelines for its use, the FCC aims to protect consumers from potential fraudulent activities and scams associated with AI-generated calls.
